Arbor Environmental provides Visual Tree Assessments for Landowners and Land agents. These assessments will illustrate tree health and condition, occupancy zones and provide recommendations (programmes of work’s) to ensure that trees situated on a clients land are safe and negligence is not an issue.
Landowners and/or Land Managers on which a tree or trees are owned and are situated within their land have a ‘common law’ duty of care under the Occupiers Liability Act 1957 and the Health and Safety at Work Act 1974, to ensure visitors and trespassers are not exposed to tree related hazards that may present a risk to their health and safety or potentially cause damages to their property.
In practice this means that if a tree fails and causes damage to a person or property than the tree owner may be liable. This duty requires tree owners to take reasonably practical steps to avoid foreseeable risk, including tree inspections and the completion of works where considered necessary.
